Terms of Service for Yajood

Welcome to Yajood! These Terms of Service ("Terms") govern your use of the Yajood mobile application (the "App") and any related services (collectively, the "Service") provided by Yajood.com.
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
1. The Yajood Service
Yajood is a social impact platform that connects consumers ("Users"), merchants ("Merchants"), and registered charitable organizations ("Charities"). The Service allows Users to obtain promotional vouchers ("Vouchers") for goods and services offered by Merchants. A key feature of these Vouchers is that their redemption triggers a donation from the Merchant to a designated Charity, facilitated by the framework provided by Yajood.
For our MVP: The Service allows Users to generate a Voucher within the App at no upfront cost. The User then presents this Voucher at the Merchant's physical location and pays the full, agreed-upon price for the goods or services directly to the Merchant. Upon this transaction, the Merchant is obligated to make the specified donation to the designated Charity. Yajood does not process any payments from the User in this version.
2. User Accounts
Eligibility: You must be at least 18 years of age to create an account and use the Service.
Account Creation: To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Account Responsibility: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account. Yajood is not liable for any loss or damage arising from your failure to comply with this security obligation.
3. Vouchers & Redemption
Obtaining a Voucher: By selecting a deal and clicking "Get a Voucher and Pay at the Shop" (or similar wording), you are issued a unique Voucher ID for a specific offer from a Merchant.
No Upfront Cost: Obtaining a Voucher from the App is free of charge. You agree to pay the full price of the deal directly to the Merchant at the time of redemption.
Redemption: Vouchers must be redeemed directly with the Merchant according to the terms and conditions specified in the deal description (e.g., expiry dates, valid days). The Merchant is solely responsible for honoring the Voucher.
Donation: The donation associated with your Voucher is made by the Merchant directly to the Charity. Yajood facilitates the connection and tracking framework but does not handle the donation funds in this version.
4. User Conduct
You agree not to use the Service to:
Obtain or attempt to obtain Vouchers through fraudulent or deceptive means.
Reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without the express written permission of Yajood.
Interfere with or disrupt the Service or servers or networks connected to the Service.
Violate any applicable local, national, or international law or regulation.
5. Role and Responsibility of Each Party
Yajood's Role: We provide the platform to connect the three parties. We are responsible for maintaining the App, showcasing the deals, and providing the framework for the donation model. We are not a party to the transaction between you and the Merchant, nor do we process or guarantee the Merchant's donation to the Charity. We make reasonable efforts to partner with reputable Merchants and Charities.
Merchant's Role: The Merchant is the seller of the goods and services and is solely responsible for:
Honoring the Voucher according to its terms.
The quality and safety of the goods or services provided.
Fulfilling their donation commitment to the designated Charity for each redeemed Voucher.
User's Role: Your responsibility is to present the valid Voucher, pay the Merchant for the goods/services, and adhere to these Terms and the specific terms of the deal.
6. Intellectual Property
The Service and its original content (excluding content provided by Users, Merchants, or Charities), features, and functionality are and will remain the exclusive property of Yajood and its licensors. The Yajood name, logo, and the Service are protected by copyright, trademark, and other laws of the UAE and foreign countries.
7. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.
8. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Yajood, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party (including Merchants and Charities) on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.
Yajood's liability is strictly limited to providing the platform service. Any dispute regarding a Voucher, product, service, or donation is between the User, the Merchant, and/or the Charity.
9. Disclaimers
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Yajood does not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; or c) the results of using the Service will meet your requirements.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United Arab Emirates, as applicable in the Emirate of Dubai, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting a notice within the App or by other means. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
